TERMS, CONDITIONS, REFUNDS, AND CANCELLATIONS
Responsibility of Booking Party
When the booking party makes reservations on behalf of other passengers in their party they assume the responsibility to make each and every passenger they book to be aware and informed of these terms and conditions as a passenger on our flights.
Things You Can And Cannot Carry On Our Flights.
• Please be at our departure location 20 minutes prior to your scheduled flight.
• We do not allow food of any type on our flights, this includes gum and candy.
• We do not allow weapons of any kind on our flights.
• No liquids are allowed on our aircraft with the exception of water.
• On our tours knapsacks, purses, backpacks, and other carry-ons are not permitted with the exception of reasonable cameras, please leave those items in your vehicle. Broadcast cameras and oversized professional camera passengers must book an appropriate type of photo flight.
Confirmations
When you submit a reservation request it is NOT a confirmation until we respond after reviewing the submitted information. You will receive an email confirmation from us when it is accepted. We cannot always confirm a reservation at the same date or time you request and may respond with the closest time available. Once you have a confirmation from us we will send detailed instructions to you the night before the flight once we check the weather and other relevant information for your flight. We usually do this before 6PM.
Cancellation Policy
You can cancel your reservation prior to 72 hours before your flight. This must be done in writing so there is no confusion by text or email, the cancellation MUST BE IN WRITING. When communicating, please have the name of the person who made the reservation originally included in the communication. Include the name, date and time of your flight that is booked. We only fly when conditions are based on actual conditions not forecasts. If we can operate the flight and you decide that conditions are not optimal for you, you will be charged a cancellation fee. Check forecast conditions 72 hours in advance if you intend to cancel. If you cancel within 72 hours of your flight you will be charged 50% of the flight cost. If we cancel due to weather or other conditions there is no cancellation fee charged.
Passenger Weights
Helicopters and airplanes have a maximum weight capacity as well as other restrictions that govern the balance of the aircraft and ensure the safety of passengers. Occasionally, to satisfy these safety requirements it may be necessary to split your group across more than 1 aircraft or flight. All helicopter or airplane passengers will be weighed at time of check in to confirm the weight listed on the reservation is accurate. When making reservations passenger weights and names are required on the booking form.
Small Children Five and Under
Flights are not recommended for small children as helicopter flights can be very uncomfortable for them. As such we do not recommend flights with small children for that reason. If you do book a flight with a child please ensure that they are under control at all times. We do not allow small children to be seated in the front center seat, however, at the discretion of the pilot this may be waived. If you intend on a small child accompanying you on any of our flights you must disclose this at the time of making your reservation.
Over Weight Passengers
Weights are based on average weights of 170 pounds per passenger on helicopter flights when there are 4 passengers or a total weight allowance of 680 pounds per flight. On certain flights there may be weight surcharges. On our airplanes this is variable based on loading configurations, length of flights and other factors. Despite the fact that airplanes may be able to seat more passengers it does not mean that every seat can necessarily be occupied.
Valid Identification
The FAA requires each passenger to present a government issued photo identification card in order to board an aircraft, such as a driver's license or passport.
Unless specified, flights may be changed without penalty up to 24 hours prior to departure, subject to availability. Rescheduling your tour within 24 hours of commencement may result in a change fee of $50. We cannot guarantee the weather so if areas have ground obscurations, bumpy air, or overcast skies you should take that into consideration prior to booking. We reserve the right to modify flight paths due to weather. We can reschedule your flight if weather is a substantial factor subject to availability. Cancellations are not allowed once reserved and confirmed by us.
ALL FLIGHT TIMES ARE APPROXIMATE. OUR OPERATIONS ARE SUBJECT TO CANCELLATION DUE TO LACK OF PASSENGER DEMAND, WEATHER, FLIGHT RESTRICTIONS, FAA LIMITATIONS, AND OTHER FACTORS BEYOND OUR CONTROL. IF WE CANCEL THE FLIGHT AND CANNOT RESCHEDULE IT WE WILL PROVIDE A COMPLETE REFUND.
Right to Refuse Service | We Only Speak and Understand English
We reserve the right to cancel (with full refund to the passenger) any reservation in which a typographical error on the website caused erroneous display of either pricing or availability during the ordering process or after order confirmation. We reserve the right to refuse service to any person for any reason; however service will not be refused based on your age, race, color, sex, or national origin. However, if your age, physical condition, language spoken, or disability prevent you from exercising, following, or understanding safety instructions from the pilot or other company representatives you are assuming all risks associated with the limitations imposed by your physical condition, ability to understand or ability to communicate with us when booking the reservation.
Packaged excursions, tours, and events.
In the event that you have purchased a tour that we operate with third parties we are not responsible for changes in currency valuation. We may act as an agent for suppliers of various travel goods and services including but not limited to ground transportation, hotel accommodations, airplane flights, meals, tours, cruises, and/or other services. We may work with these suppliers in selling packaged travel related services and/or in accepting reservations or bookings for services that may not be directly supplied, managed, or otherwise provided by us. We attempt to work with only suppliers that have shown an acceptable level of stability, dependability, and responsiveness to problems and complaints; nevertheless, we cannot and do not control the actions or inactions of the suppliers it represents. Therefore, we shall not be responsible for any breach of contract, failure to comply with any laws including but not limited to the American with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers resulting in any loss, property damage, delay, inconvenience, or personal injury to travelers, travelers' companions, or group members, including but not limited to any losses resulting from changes in suppliers' rates, losses in connection with bookings, reservations, connections, or scheduling problems, or losses arising out of the handling or loss of baggage or other personal effects. We shall not be responsible for any injuries, damages, or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or deficiencies, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside our control.
Assumption of Risk
By embarking upon his/her travel, the traveler voluntarily and expressly assumes all risks associated with such travel, whether foreseeable or unforeseeable. We and the suppliers of ground transportation, airplane flights, and various other goods and services reserve the right to change the accommodations, flights, and any and all details of the tour itinerary as needed. The travelers’ booking of reservations or utilization of services after confirming their reservations acknowledges receipt of this information which will constitute consent to the above and an agreement on his/her part to provide copies hereof to his/her companions or group members together with an explanation that if they embark, they do so subject to these Terms and Conditions of Service. It is the responsibility of the reservation booking party to make any other passengers in their party booked as part of the original reservation of these Terms and Conditions of Service.
